This license does not include any resale or commercial use of any Halocarbon Service, or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of any Halocarbon Service or its contents; any downloading or copying of account information for the benefit of another business activity; or any use of data mining, robots, or similar data gathering and extraction tools. 6. ARBITRATION.
The parties will submit any dispute related to or arising out of the Site or these Terms of Use to arbitration in Atlanta, Georgia before one arbitrator under the American Arbitration Association’s Commercial Arbitration Rules. A party may seek interim relief from any court having jurisdiction without waiving any remedy under this Agreement. The arbitrator may not award punitive damages or other damages not measured by actual damages, or limit, expand or otherwise modify the terms of this Agreement. A party may enter a judgment on an award in any court having jurisdiction. The prevailing party is entitled to an award of reasonable attorney fees. This Agreement is governed by the laws of the state of Georgia.
7. EFFECTIVE DATE; MODIFICATIONS; SEVERABILITY
This Agreement takes effect on the date you first use the Site and continues for as long as you use the Site. HALOCARBON RESERVES THE RIGHT TO CHANGE THIS AGREEMENT AT ANY TIME BY POSTING CHANGES ON-LINE. YOU ARE RESPONSIBLE FOR REVIEWING REGULARLY ALL INFORMATION POSTED ON-LINE CONCERNING USAGE POLICIES IN ORDER TO OBTAIN TIMELY NOTICE OF SUCH CHANGES. YOUR CONTINUED USE OF THIS SITE AFTER CHANGES ARE POSTED CONSTITUTES YOUR ACCEPTANCE OF THIS AGREEMENT AS MODIFIED BY THE POSTED CHANGES. Onward Transfer
Halocarbon is a global organization with global processes and practices; our servers, databases, and service providers are located in the United States and other countries. Where permitted by law, Halocarbon may send PI to its subsidiaries and affiliates as well as third parties including but not limited to, service providers, external parties, law enforcement and government authorities or Halocarbon’s successors in the event Halocarbon sells or transfers all or a portion of its business assets. In each of these circumstances, Halocarbon will take all reasonable steps to ensure any transfer is done within the confines of any applicable law and in a secure manner, is necessary to perform the services required, and is executed in a manner consistent with this Notice.
Data Integrity and Data Security
Halocarbon will take all reasonable steps to protect your PI, keep your PI reliable for its intended use, accurate, current, and complete, as well as in identifiable form only for as long as necessary for the purposes for which it was collected.
Your Choice
Halocarbon will notify you and obtain consent prior to using your PI in a manner inconsistent with the purposes described in this Notice, purposes disclosed at the time of collection, or purposes subsequently authorized.
